Licensing

By purchasing an Art of Opal™ item, image, or opal, you acknowledge that you are acquiring the physical product (painting, print, or opal) only. Art of Opal™ retains exclusive rights to the artistic license and ownership of the image, including the right to reproduce and sell the image. These rights remain solely with Art of Opal™ and are not transferred with the purchase.

Investor Resale Possibility

“If you have owned an item—whether it be an opal art combination or a print itself—for a period of three years or longer, Art of Opal may at their discretion offer you the opportunity to resell the piece you purchased. While we cannot guarantee the performance of investments due to market trends and fluctuations beyond our control, we endeavor to assist our valued investors in whatever way possible Conditions apply.

1. General Information

Yowah Proprietary Limited, trading as Art of Opal (“Art of Opal”, “we”, “us”, “our”), is registered in Australia and operates under Australian law. These terms and conditions govern the use of our website and the sale of our products.

By using this website and/or placing an order, you agree to comply with these terms and conditions.

2. Products

Art of Opal specializes in selling packages featuring an artwork either painted ,printed or sculptured. Each piece is a unique rendition or enhancement of the opal it contains.

We do not sell opals separately at this time.

3. Payment and Pricing

We accept all major payment gateways, including PayPal, Stripe, major credit cards, and bank transfers. Layby or Afterpay maybe made available at our discretion. Failure to complete payments or maintain contact for over three months will result in the product being deemed abandoned and returned to stock, with no refunds or credits.

Pricing may be displayed in multiple currencies, subject to changes without prior notice based on market trends and payment gateway rules.

4. Shipping and Delivery

We offer standard postage worldwide included in the purchase price of all items with options to upgrade to express shipping with insurance. By making a purchase with Art of Opal(tm) you agree without reservation to our choice of courier used for shipping based on cost and reliability.

Insurance is optional and recommended. Whilst taking every care and assuming responsibility for items lost or damaged before handing over to the postage consignee, we do not accept responsibility for loss, damage or associated import duties and taxes that are outside of our control once the item has been dispatched.

Shipping times and couriers may vary depending on the product’s origin. Most items will ship from Australia, though some may come from other international offices.

5. Returns and Refunds

Our return policy allows for exchanges only within 30 days for genuine reasons at the discretion of Art of Opal and subject to requirements of the department of fair trading. (Link : or as found on thier website)

We do not offer refunds or returns on custom orders. Customers are responsible for the return shipping costs.

6. Intellectual Property

The “Art of Opal” name and the AO logo are registered trademarks, and no permission is given to use these trademarks without written authorization.  All content on the website, including images, designs, and the concept of selling opals within artwork, is protected as intellectual property. Any unauthorized use of our intellectual property is strictly prohibited and may result in legal proceedings.

7. Customer Data and Privacy

We collect personal information (e.g., names, addresses, email addresses, phone numbers etc) only for the purpose of fulfilling orders, providing services and in-house marketing.

We will not share customer data with third parties unless necessary (e.g., with postal services for shipping etc). All data is handled in compliance with applicable privacy laws.

We may use customer data for internal marketing purposes, including email promotions and advertisements. By using the site, you agree to receive such communications, though you can opt-out at any time.

8. Governing Law

These terms and conditions are governed by the laws of Australia. Any disputes that arise will be handled in compliance with the Australian Department of Fair Trading.

We reserve the right to determine the resolution of any disputes that arise regarding purchases or the use of this website.

10. Website Use and Account Creation

To make purchases on the Art of Opal website, users will be required to create an account. We may use pop-up notifications to prompt account creation. We reserve the right to limit who can use the website or access certain features at our discretion.
